2. What personal data do we collect and process?

When you visit our website and interact with us, we collect and process the following personal data:

  • Phone number
  • Other data you enter into inquiry forms or when communicating with us (e.g. message content).

  • Provision of services and performance of contracts:
    • Purpose: Managing orders, providing services, processing payments, providing customer support, and managing customer relationships.
    • Legal basis: Fulfilling a contract with a customer or taking measures before entering into a contract.
  • Fulfillment of legal obligations:
    • Purpose: Fulfillment of accounting, consumer dispute resolution and other legal requirements.
    • Legal basis: Compliance with a legal obligation.

4. Recipients of personal data (third parties)

We will only share your personal data with third parties if it is necessary for the purposes mentioned above and to a strictly limited extent. Our processors are required to ensure appropriate safeguards when processing personal data.

Your data may be transferred to the following third-party processors:

  • Email service provider: Forklift OÜ uses Google Workspace email services to manage email correspondence between us and you.
  • Customer Relationship Management (CRM): We use a customer relationship management system to manage your inquiries and communications, your contact details are stored in this system.
  • Website hosting and information technology service providers: If this is necessary to ensure the functionality of our website or to ensure data hosting, data may be transferred to our IT partners. These partners process the data strictly according to our instructions.
  • Analytics service providers:
    • Google Ireland Limited: Regarding Google Analytics 4 (GA4) When using this website, data (e.g. IP addresses as anonymous identifiers, browsing behavior) may be transmitted to Google for analysis purposes.
  • Advertising service providers:
    • Google Ireland Limited: Regarding Google Ads service (including remarketing), data may be transferred to Google to show you relevant ads.
    • Meta Platforms Ireland Ltd.: Regarding Facebook Pixel By using it, data may be transferred to Meta to show you relevant ads on Facebook platforms.

Transfer of data to third countries (outside the EU/EEA):
If any of our processors (e.g. Google, Meta) are located outside the European Union or the European Economic Area (EU/EEA), in particular the United States, your personal data will only be transferred if appropriate safeguards are in place. Such safeguards include the Standard Data Protection Clauses (SCCs) approved by the European Commission and/or the EU-US Data Privacy Framework (if the service provider is certified under this framework) together with additional security measures necessary to ensure data protection in accordance with the requirements of the GDPR.

5. Security and data access

We implement appropriate physical, organizational and information technology security measures to protect your personal data against accidental or unlawful destruction, loss, alteration or unauthorized access and disclosure.

Access to your personal data is limited to FORKLIFT employees who need the data to perform their duties and provide customer service. All employees are subject to a confidentiality obligation.

6. Data retention

We will retain your personal data for as long as necessary to fulfill the purpose for which the data was collected, or as long as you have an active relationship with Forklift OÜ.

  • Data related to customer communication and inquiries (name, email, phone, IP address, content of the inquiry) is generally retained for up to 3 years after the last contact so that we can answer follow-up questions or manage potential disputes.
  • System logs, which include IP addresses, are retained for 90 days for security and system stability purposes.
  • Data collected through analytical and marketing cookies (e.g. Google Analytics data) is retained in accordance with the data retention policies of the respective service provider, but we strive to keep it for the shortest possible time (e.g. setting the data retention period for GA4 to 14 months, where possible).
  • Information requiring longer retention (e.g. accounting data, should it arise) will be retained in accordance with the law (7 years).

7. Your rights

You have the following rights in relation to the processing of your personal data:

  • Right to access data: You have the right to obtain confirmation as to whether we are processing your personal data and to receive a copy of the data being processed.
  • Right to rectification of data: You have the right to request the correction of inaccurate personal data and the completion of incomplete personal data.

After you object, we will assess whether we have compelling and legitimate grounds for the processing that override your interests, rights and freedoms.
  • Right to withdraw consent: If the processing of personal data (including through analytical and marketing cookies) is based on your consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before withdrawal.
  • Right to file a complaint: You have the right to file a complaint with the Data Protection Inspectorate (AKI) (www.aki.ee) if you find that your rights have been violated in the processing of your personal data.
